This privacy policy (this "Policy") describes the practices of Servvis Inc. ("Servvis") and its corporate affiliates ("we", "us", "our") with respect to our collection, use, storage and disclosure of information which can be used to identify an individual ("Personal Information"). This Policy applies to all websites, mobile applications, and other online services (collectively, "Platform") made available by Servvis.
This Policy is incorporated by reference to the Business Owners" Terms of" Use "for Servvis located at www.servvis.com/agreements/admin/terms_and_conditions.html, Clients' Terms of Use for Serrvis located at www.servvis.com/agreements/client/terms_and_conditions.html and forms an integral part of it. All capitalized terms not otherwise defined herein have the meaning provided in the Business Owners" Terms of Use and Clients" Terms of Use for Servvis. Except as otherwise explicitly provided herein, this Policy applies only to information collected on or through the Platform, and it does not apply to information collected or obtained by or through any other means (including, without limitation, information collected offline, in person, over the telephone and/or by mail, or from third-parties outside the Platform).
We process your Personal Information only to the extent necessary for the performance of our obligations to you, which is in providing the Platform to you under our Terms of Use for Business Owners and Terms of Use for Clients. Except as set forth in this Policy, your Personal Information will not be used for any other purpose without your consent. We will not actively collect Personal Information for the purpose of sale or third-party marketing in a way that specifically identifies the individual. In other words, we don't sell User lists.
By using the Platform, you confirm that you have read, understand, and consent to the collection, use and disclosure of your Personal Information as explained in this Policy. You may change or withdraw your consent at any time, subject to legal or contractual restrictions and reasonable notice, by contacting our Privacy Officer using the contact information set out below. In some circumstances, changing or withdrawing consent may result in your inability to continue using the Platform. IF YOU DO NOT AGREE TO THIS POLICY, PLEASE DO NOT ACCESS OR USE THE PLATFORM.
1. INTRODUCTION AND GENERAL TERMS
We respect and uphold individual rights to privacy and the protection of Personal Information. We know how important it is to protect your Personal Information and want to make every Users experience safe and secure. In keeping with that goal, we have developed this Policy to explain our practices for the collection, use, and disclosure of your Personal Information. We have appointed a Privacy Officer who is responsible for our compliance with this Policy. Information on how to contact the Privacy Officer can be found below.
1.1. Personal Information. For the purposes of this Policy, "Personal Information" means information about an identifiable individual, including, for example, an individual's name, home address, telephone number, social insurance number, sex, income and family status. Personal Information does not include information that would enable an individual to be contacted at a place of business, for example an employee's name, position or title, business telephone number, or business address. We will only collect, use or disclose Personal Information in accordance with this Policy, or in accordance with laws applicable to the collection, use and disclosure of your Personal Information by us ("Applicable Privacy Laws").
1.2. Non-Personal Information. On the other hand, "non-personal information" is any type of information other than Personal Information, and is excluded from this Policy. For example, non-personal information would include business information, or information that enables an individual to be contacted at a place of business, for example an employee's name, position or title, business telephone number, or business address. Non-Personal Information also includes information that is anonymous or not about an identifiable information, such as web browsing information (such as the domain used to access the Website, or the type and version of device, browser or operating system being used to access the Platform), or aggregate information that anonymizes the underlying data (like the number of visitors, what pages Users visit, average time spent on the Website or on various parts of the Platform). We will collect, use or disclose non-personal information in accordance with our ordinary business practices, but always in accordance with any applicable laws. This Policy, however, only covers our collection, use and disclosure of Personal Information.
1.3. Information about Minors. This site is not intended for minors and no person under the age of majority may register for a User Account. We do not knowingly collect Personal Information about any person under the age of majority (usually the age of 18 or 19, but it varies in different jurisdictions) including any person under the age of 13, and no such person, nor any parent or guardian as it relates to such person, should submit their Personal Information to us for any reason. Please do not submit Personal Information about minors to us, whether through the Platform or otherwise.
1.4. A Note to Users Outside of Canada. If you are a non-Canadian User of the Platform, by visiting or using the Platform and providing us with data, you acknowledge and agree that your Personal Information may be processed for the purposes identified in this Policy. In addition, your Personal Information may be processed in the country in which it was collected and in other countries, including Canada, where laws regarding processing of Personal Information may be less stringent than the laws in your country. 2. INFORMATION WE COLLECT
How we collect and store information depends on how you access and use the Platform. We collect information in multiple ways including when you provide information directly to us, when you permit third-parties to provide information to us, and when we automatically collect information from you, such as information collected from your browser or device.
2.1. Personal Information we collect from you. We may collect registration data such as your full name, email address, mailing address, phone number, as well as business contact information. We may also collect payment credentials or related information from our Users in order to allow those Users to pay for Services procured or in order to remit to such Users their share of the Service Payment. We may also collect any User Content generated by you, such as audio, video, text and images, which may contain Personal Information as provided by you. We may also collect information specific to the Service requested or offered through the Platform, such as a business name, Service description, qualifications and credentials.
2.2. Information we automatically collect. We may automatically gather information about your device such as your IP address, browser type, referring/exit pages, operating system, as well as which aspects of our performance metric indicators available with our technology or our licensees' products you prefer using. Some of this may be Personal Information, but in typical cases it is non-personal information. Set below are ways in which we automatically collect information:
2.2.1. Logs. Our servers automatically record information created by your use of the Platform to help us diagnose and fix technical issues, and to improve the overall quality and User experience of the Platform. Logs may include information such as your IP address, browser type, operating system, details of how you used the Platform (such as the functions you asked our Platform to perform), diagnostic information related to the Platform (such as crash activity reports), the referring web page, pages visited, location, your mobile carrier, device and application IDs, search terms, and cookie information. Please see further below for more information on this.
2.2.2. Cookies. We use "cookies", a technology that installs a small amount of information on a User's computer to permit the Platform to recognize future visits using that device. Cookies enhance the convenience and use of the Platform. For example, the information provided through cookies is used to recognize you as a previous User of the Platform, to offer personalized content and information for your use, to track your activity at the Platform, to respond to your needs, and to otherwise facilitate your Platform experience. You may choose to decline cookies if your device permits, but doing so may affect your use of the Platform and your ability to access certain features of the Platform or engage in transactions through the Platform.
2.2.3. Geo-Location Information. When you use the Platform, we may collect general location information (such as IP address). If you install our mobile app, we may ask you to grant us access to your mobile device's geolocation data. If you grant such permission, we may collect information about your precise geolocation, and we may use that information to improve the Platform, including providing you with location-based features (e.g. for identification of Service Professionals available near you). If you access the Platform through a mobile device and you do not want your device to provide us with location-tracking information, you can disable the GPS or other location-tracking functions on your device, provided your device allows you to do this. See your device manufacturer's instructions for further details. If you disable certain functions, you may be unable to use certain parts of the Platform.
2.2.4. Biometric Information. When you access the Platform using our mobile app, we may collect biometric data, such as fingerprints, facial recognition and other information used to sign into your User Account that can be used to identify you.
3. HOW WE USE THE INFORMATION WE COLLECT
Servvis uses the Personal Information described above to:
3.1. provide, operate, maintain, and improve the Platform;
3.2. account administration, billing, verification, and authentication purposes and to contact you in relation to the same;
3.3. distribute to our Payment Processor for the provision of payment Services;
3.4. send technical notices, updates, security alerts, and support and administrative messages;
3.5. facilitate transactions and send related information to the relevant transaction participants, including confirmations, quotes, and invoices;
3.6. store information about User preferences and customize the Platform according to individual interests;
3.7. respond to comments, questions, and requests, and provide customer service and support;
3.8. communicate with you and provide news or information about us;
3.9. investigate and prevent fraudulent transactions, unauthorized access to the Platform and other illegal activities;
3.10. monitor and analyze trends, usage, and activities in connection with the Platform, including generating aggregated and anonymized statistics and disclosing industry trends to third parties which are derived from use of the Platform but do not include any Personal Information;
3.11. conduct business and contractual relationships that we have with various persons and companies (such as Users, suppliers, partners, and employees); and
3.12. for other purposes which we will notify you about and seek your consent.
4. DISCLOSURE AND SHARING OF PERSONAL INFORMATION
We will share your Personal Information with third parties only in the ways that are described in this Policy. We will not sell your Personal Information to third parties; however, the use of the Platform necessarily requires some sharing or disclosure of your Personal Information. Some of these activities may result in Personal Information collected by us being stored or processed in Canada or elsewhere outside of Canada and, as a result, your Personal Information may be accessible to law enforcement and regulatory authorities in accordance with applicable laws.
4.1. Payment Processors. When you provide credit card or other payment information, your credit card and financial information is processed by a third-party provider. Servvis does not store and does not have access to detailed credit card information. If you use the Platform, your payment information and payments will be processed by Stripe Inc. and such information and processing will be subject to Stripe's own legal agreements which you should read carefully.
4.2. Our Business Providers. We may provide access to your information to select third-parties who perform services on our behalf. These third-parties provide a variety of services to us including without limitation billing, sales, marketing, advertising, market research, fulfillment, data storage, analysis and processing, identity verification, fraud and safety protection and legal services. As we retain new providers, we generally seek contractual assurances from these providers that they will not use your information in any manner other than to help us provide you with the Platform available from Servvis.
4.3. As Required by Law. We may disclose your Personal Information to third parties without your consent if we have reason to believe that disclosing this information is necessary to identify, contact, or bring legal action against someone who may be causing injury to or interference with (either intentionally or unintentionally) our rights or property, other Users, or anyone else (including the rights or property of anyone else) that could be harmed by such activities. Further, we may disclose Personal Information when we believe in good faith that such disclosure is required by and in accordance with the law. We also reserve the right to access, read, preserve, and disclose any information as we reasonably believe is necessary to:
4.3.1. satisfy any applicable law, regulation, legal process, or governmental request (including in pursuant to subpoenas, civil investigative demands, or similar processes);
4.3.2. enforce our contracts or User agreements, including investigation of potential violations hereof; and
4.3.3. detect, prevent, or otherwise address fraud, security, or technical issues.
4.4. Business Transfers. If our business (or substantially all of our assets) are acquired by a third party, or if we go out of business, enter bankruptcy, or go through some other change of control, Personal Information may be made available or otherwise transferred to the new controlling entity, where permitted under applicable law. Your Personal Information may also be transferred in connection with due diligence for any such transactions. In all cases, if any such transactions occur, your Personal Information will remain subject to the restrictions and protections set forth in this Policy.
4.5. App Store Providers. We may provide your identity and mobile device identifier to third-party app store providers (for example, the Apple App Store) to allow you to download our mobile apps.
5. SECURITY OF PERSONAL INFORMATION
5.1. We employ physical, procedural, and technological security measures to help protect your Personal Information from unauthorized access or disclosure. Servvis may use encryption, passwords, and physical security measures to help protect your Personal Information against unauthorized access and disclosure. No security measures, however, are 100% failsafe. Therefore, we do not promise and cannot guarantee, and thus you should not expect, that your Personal Information or communications will not be collected, disclosed and/or used by others. You should take steps to protect against unauthorized access to your password, phone, and computer by, among other things, signing off after using a shared computer, choosing a robust password that nobody else knows or can easily guess, keeping your log-in and password private, and not recycling passwords from other websites or accounts. Servvis is not responsible for the unauthorized use of your information nor for any lost, stolen, or compromised passwords, or for any activity on your account via unauthorized password activity.
6. OTHER RIGHTS AND RESPONSIBILITIES
6.1. Retention. We will keep your Personal Information for as long as it remains necessary for the identified purpose or as required by law, which may extend beyond the termination of our relationship with you. We may retain certain data as necessary to prevent fraud or future abuse, or for legitimate business purposes, such as analysis of aggregated, non-personally identifiable data, account recovery, or if required by law. All retained Personal Information will remain subject to the terms of this Policy. If you request that your Personal Information be removed from our databases, it may not be possible to completely delete all your Personal Information due to technological and legal constraints.
6.2. Access, Accuracy, and Deletion. You have the right to access the Personal Information we hold about you in order to verify the Personal Information we have collected in respect to you and to have a general account of our uses of that information. You must promptly update your account information if it changes or is inaccurate. Upon your request, we will close your account and remove your profile information from view as soon as reasonably possible. We may retain information from closed accounts in order to comply with the law, prevent fraud, collect any fees owed, resolve disputes, troubleshoot problems, assist with any investigations of any User, enforce our Terms and Conditions, and/or for any other purposes otherwise permitted by law that we deem necessary in our sole discretion.
6.3. Amendment of this Policy. We reserve the right to change this Policy at any time. If we decide to make any material changes to this Policy in the future, including how we use your Personal Information, we will send you an email or in-Platform notification. Any non-material change (such as clarifications) to this Policy will become effective on the date the change is posted and any material changes will become effective 30 days from their posting on the Platform, unless expressly acknowledged by you at an earlier date. Unless stated otherwise, our current Policy applies to all Personal Information that we have about you. The date on which the latest update was made is indicated at the top of this document. Your continued use of the Platform signifies your acceptance of any changes. You should consult this Policy regularly for any changes.
